[Opinion] The Public Cannot Accept a Justice Minister Facing Allegations of Improper Solicitation and a Past Suspended Prosecution
Kim Young-jin (Professor, School of Law and Public Administration, Daejeon University; Former President, Daejeon Institute)
The foremost virtues required of the head of a law enforcement agency are a high level of morality and a commitment to the rule of law. This is because the Minister of Justice serves as the symbol of judicial justice and the bulwark of the rule of law in South Korea.
The public is dismayed by the controversy surrounding Kim Seung-won, the nominee for Minister of Justice currently undergoing confirmation hearings.
He has a past record of receiving a "suspended prosecution" (a decision by a prosecutor to withhold indictment despite acknowledging the offense) following allegations of improper solicitation regarding clinical trials. A suspended prosecution is merely an act of leniency; it does not signify innocence or an acquittal. He has also been fined for violating the Road Traffic Act.
It is difficult to comprehend how an individual who has faced judicial allegations and criminal fines could assume the role of Justice Minister—a position responsible for overseeing the nation's legal order and commanding the prosecution service.
At a time when even the appointment of ordinary civil servants involves strict scrutiny for disqualifying factors, nominating a person with a criminal record to a position demanding the highest moral standards among cabinet members shows a complete disregard for the public's common sense and expectations.
Furthermore, there is a mountain of risks surrounding his family, including allegations that his spouse operated a school illegally. The call transcripts and specific details revealed daily by the opposition party and the media are rendering the ruling party's explanations—dismissing the issues as "simple civil complaints" or "political smear campaigns"—wholly unconvincing. The fact that even progressive civic groups and allied forces—once staunch supporters of the administration—are turning their backs after pointing out disqualifying flaws serves as proof of just how ill-advised this nomination was.
The government and the ruling party are rallying to defend nominee Kim, hailing him as the "right person for prosecution reform." However, few citizens are likely to place their trust in reforms driven by a minister who lacks both legal and moral legitimacy.
The cause of reform must not serve as a shield to cover up allegations of unfairness and preferential treatment surrounding the nominee. In fact, the majority of the public harbors deep skepticism, questioning whether this appointment is truly about realizing judicial justice or merely a "cabinet reshuffle to shield the administration," given his past history of advocating for the withdrawal of indictments in cases involving the previous administration.
The recent public opinion poll showing opposition to the appointment exceeding 60% serves as a stern warning from the people to the administration.
The President must face the honest voice of public sentiment. There must be no repeat of the practice of forcing through an appointment after a mere perfunctory hearing, in defiance of public opposition. Such actions amount to an act of self-sabotage that erodes the momentum of state governance and constitute an affront to the rule of law.
For the judicial reform pursued by the administration to be recognized as genuine, making a decisive political choice is the logical course of action. One cannot uphold the rule of law with a flawed figure.
