Myeongnyundang, Operator of 'Myeongnyun Jinsagalbi,' Charges 18% Interest to Franchisees After Receiving Low-Interest Policy Loans

Allegations have been officially raised that Myeongnyundang, the operator of Myeongnyun Jinsagalbi, received low-interest government policy loans but then provided high-interest loans to franchisees and charged inflated interior construction costs.

According to the Fair Trade Commission (FTC) on the 11th, an FTC investigator sent an investigation report regarding Myeongnyundang's alleged violation of the Franchise Business Act to the company on the 8th.

The FTC plans to hold a plenary meeting to determine the level of sanctions, including issuing corrective orders, imposing fines, and filing criminal charges.

According to recent investigations by financial authorities, Myeongnyundang secured a total of 83 billion won in policy funds at low interest rates of 3–6% per year, including 79 billion won from the Korea Development Bank, 2 billion won from the Industrial Bank of Korea, and 2 billion won from the Korea Credit Guarantee Fund. Approximately 89.9 billion won of these funds were re-lent through 14 related lending companies established by the major shareholders of Myeongnyundang.

These 14 lending companies are suspected of engaging in so-called "fragmented registration" to avoid meeting the Financial Services Commission's registration requirements of "total assets of 10 billion won and outstanding loan balances of 5 billion won."

It has been determined that these lending companies provided high-interest loans ranging from 12% to 18% per year to Myeongnyun Jinsagalbi franchisees under the pretext of covering interior renovation costs.

Due to this structure, it is reported that the interest arbitrage profits Myeongnyundang pocketed in the middle alone amount to billions of won. This created a structure where profits could be made simply by increasing the number of franchises, regardless of the franchisees' actual profits.

The Fair Trade Commission also believes that Myeongnyundang inflated the costs of interior construction, equipment, and fixtures during the franchise opening process, thereby placing an excessive burden on franchisees. Furthermore, the Commission is investigating indications that the company forced franchisees to do business with specific interior design firms. In addition, the Fair Trade Commission (FTC) pointed out a problem in the fact that Myeongnyundang brokered loans for franchisees while listing the relevant details as "not applicable" in its disclosure statement. The FTC considers this to be a false statement.

Accordingly, an FTC investigator has submitted recommendations to the Commission regarding a corrective order, the imposition of a fine, and referral to the prosecution.

Meanwhile, Myeongnyundang was sanctioned last year by the Seoul Metropolitan Government’s Public Livelihood Judicial Police Bureau for issues regarding high-interest loans to franchisees. During the investigation at the time, it was found that Myeongnyundang evaded charges by obtaining funds at low interest rates from the Korea Development Bank from 2023 to the end of 2024 and providing loans to franchisees at annual interest rates of 12–15%, thereby collecting a total of 15.5 billion won—including 9.9 billion won in loan repayments and 5.6 billion won in interest.

Consequently, the Seoul Metropolitan Government’s Public Livelihood Judicial Police Bureau referred the CEO of Myeongnyundang to the prosecution on charges of violating the Money Lending Business Act.

However, this FTC investigation is proceeding separately from the Seoul Metropolitan Government investigation. The Fair Trade Commission is even looking into whether franchisors have violated the Franchise Business Act, such as by providing disadvantages or disclosing false information.

In this regard, an official from the Fair Trade Commission stated, "The investigation conducted by the Seoul Metropolitan Government focused on loans made through lending companies, whereas the Fair Trade Commission is examining not only lending companies but also interest-free loans previously provided to prospective franchisees and contract holders."
