The Gyeongsangnam-do Provincial Police Agency has arrested and referred to the prosecution four individuals involved in illegal brokerage activities disguised as real estate consulting firms or real estate transactions using nominee ownership arrangements.
The Gyeongsangnam-do Provincial Police Agency announced that it recently arrested and referred without detention three unlicensed brokers who engaged in real estate brokerage without licenses and one individual involved in real estate nominee ownership arrangements, on charges of violating the Licensed Real Estate Brokerage Act and the Act on Registration of Real Estate Ownership in the Name of the Actual Owner.
According to the police, the Namhae Police Station uncovered a group of two individuals who operated an unregistered brokerage office under the guise of a real estate consulting firm, brokered a land sale, and split the 2 million won received as a commission.
Additionally, the Hapcheon Police Station arrested one unlicensed broker who received a commission of 5.5 million won for brokering a land transaction without a license, and one individual involved in registering a nominee ownership arrangement for the purpose of tax evasion during the transaction.
The police urged the public to exercise extreme caution, noting that cases have recently occurred where some unqualified operators are using the trade name "Real Estate Consulting" to operate as if they were legitimate brokerage firms.
The Licensed Real Estate Brokerage Act stipulates that engaging in brokerage business without registering to open a brokerage office is punishable by imprisonment of up to three years or a fine of up to 30 million won. Additionally, the Real Estate Registration Act allows for the imposition of imprisonment of up to five years or a fine of up to 200 million won for acts of nominee ownership.
The police emphasized that to prevent disputes over rights and damages, one must verify whether the company in question is a formally registered brokerage firm and whether the broker holds a licensed real estate broker qualification before engaging in a real estate transaction.
An official from the Gyeongnam Provincial Police Agency stated, "The name 'Real Estate Consulting' alone does not constitute recognized brokerage qualification," adding, "We plan to continuously strengthen crackdowns on crimes that disrupt the order of real estate transactions, such as unqualified brokerage activities and nominee ownership."
Meanwhile, brokerage registration status can be verified through the "Find Broker and Legal Representative" service on the Ministry of Land, Infrastructure and Transport's Electronic Real Estate Transaction System.
