Jeonnam Election Commission Files Charges Against 3 Individuals for 'Candidate Bribery and Donation'
"Strict Response to Offering Positions in Exchange for Withdrawal and Cash Distribution"
(Muan = Break News) Reporter Lee Hak-su = The Jeollanam-do Election Commission announced on the 4th that it filed charges with investigative authorities against a total of three individuals on charges of violating the Public Official Election Act in relation to the 9th National Simultaneous Local Elections. These charges include expressing an intention to bribe candidates and making donations to constituents.
According to the Jeonnam Election Commission, preliminary candidate A for the ◇◇ City Council election planned to run as an independent candidate in a different constituency after being eliminated from his party's primary around mid-April. During this process, A is suspected of visiting B, an independent preliminary candidate already registered in the same constituency, and pressuring him to withdraw from the race.
It was revealed that A attempted so-called "candidate bribery," promising B the position of campaign manager and additional financial benefits in exchange for B giving up his candidacy. Article 232 of the Public Official Election Act (Crimes of Bribery and Inducing Understanding of Candidates) strictly stipulates that anyone who offers money, valuables, or public or private positions, or expresses an intention to prevent a candidate from becoming one, shall be punished with imprisonment for up to seven years or a fine ranging from 5 million won to 50 million won.
In addition, two individuals were separately reported to the prosecution on charges of providing cash to constituents.
Mr. B, a volunteer for a preliminary candidate for the ▢▢ County Council, is accused of visiting a specific constituent in early April and handing over 300,000 won in cash while soliciting support for the candidate.
Mr. C, an acquaintance of the same preliminary candidate, is accused of visiting a store run by a constituent in mid-April and providing 200,000 won in cash along with the candidate's business card. According to Article 115 of the Public Official Election Act (Restrictions on Third-Party Donation), no one may make a donation on behalf of a candidate in relation to an election, and violations are punishable by imprisonment for up to five years or a fine of up to 10 million won.
An official from the Jeonnam Provincial Election Commission emphasized, "Acts of influencing a candidate's decision to run for office or attempting to buy votes through the provision of money or benefits are serious crimes that infringe upon the free formation of will, which is the foundation of democracy."
Anticipating that similar illegal acts will become rampant as the local elections approach, the Commission plans to respond strictly by concentrating its enforcement capabilities.
