Gwangju Metropolitan City Wins 12th Consecutive Water Supply Developer Pays Lawsuit… Defends 4.4 Billion Won in Finances

Supreme Court Finalizes Legal Principle That "Building Owners Are Also Developers When Tap Water Usage Increases Significantly." Fruits of Proactive Administration Including TF Formation… Expectations for Conclusion of Legal Disputes Surrounding Developer Pays

(Break News Gwangju, Jeonnam) Reporter Lee Hak-su = The Waterworks Headquarters of Gwangju Metropolitan City is achieving significant results in securing the financial soundness of its water supply system by winning 12 consecutive legal disputes regarding developer pays for water supply.

Gwangju Metropolitan City announced on the 28th that the Supreme Court, in the final appeal hearing held recently (August 12) regarding the "Lawsuit to Cancel the Imposition of Developer Pays for Water Supply," confirmed the lower court's ruling in favor of the Waterworks Headquarters. This case began when actual tap water usage surged approximately 22 times compared to the amount projected during the land readjustment project, following the construction of a mixed-use apartment complex in an area originally planned for commercial use. The building owner argued that they were not subject to the levy because they were not the original project developer and the construction was within the scope of the planned use. However, the Supreme Court ultimately recognized the legal principle that if tap water usage increases significantly beyond the original plan, the building owner who caused the increase can also be considered the actual causer.

Unlike previous similar lawsuits, which were judged based on whether the building's size and use fell within the planned scope, this ruling is significant in that it presents a forward-looking standard for determining the causer based on the "concrete increase in actual water usage."

The Water Supply Causer Pays Fee (Article 71 of the Water Supply Act) is a system that requires the causer to bear a portion of the costs when the new construction or expansion of water supply facilities is necessary due to a development project. However, due to differences in legal interpretation within redevelopment and reconstruction zones, a series of related lawsuits ensued until 2023. The Waterworks Headquarters faced difficulties, including a financial burden of approximately 4 billion won resulting from consecutive defeats in these cases.

In response, the Waterworks Headquarters formed a task force (TF) led by the Director and shifted to proactive administration by analyzing precedents and developing response strategies that reflected on-site conditions. As a result, it achieved consecutive victories in 12 out of 14 lawsuits filed since 2024 (with 2 cases still pending), preventing a financial outflow of 4.4 billion won. Furthermore, it significantly strengthened its legal capabilities, notably by securing a Supreme Court victory regarding the fixed-rate water supply construction fee system last February.

Kim Il-yung, Director of the Waterworks Headquarters of Gwangju Metropolitan City, said, “In the past, the financial burden was heavy due to a lack of systematic response, but since 2024, we have strengthened our litigation response system through the development of preemptive legal principles.” He added, “As the major issues regarding the polluter pays principle have been resolved with this Supreme Court ruling, we expect it to contribute significantly to the financial stabilization of the waterworks system.”
